2. The Regulator's guide (section 51(1)(b))
The Information Regulator has published a guide on how to use PAIA, available in all official languages from the Information Regulator: inforegulator.org.za, enquiries@inforegulator.org.za, JD House, 27 Stiemens Street, Braamfontein, Johannesburg.
3. Categories of records held (section 51(1)(c))
Webology holds the following categories of records: company and financial records (invoices, quotes, banking, tax and SARS records); client records (contracts, correspondence, project specifications, website and system source code prior to handover); marketing records (this website's content and enquiry submissions); operational records (hosting configurations, backups, credentials held on behalf of clients); and personnel records to the extent any exist. Some records are available without a PAIA request — this website, published prices, and any record you supplied to Webology yourself.
4. Records available under other legislation (section 51(1)(d))
Records may also be available under, among others, the Companies Act 71 of 2008, the Consumer Protection Act 68 of 2008, the Electronic Communications and Transactions Act 25 of 2002, the Tax Administration Act 28 of 2011, and POPIA (for your own personal information).
5. How to request access (section 51(1)(e))
Complete Form 2 (Request for Access to Record of Private Body), available from the Information Regulator's website, and send it to the Information Officer at the email address above. Identify the record clearly, state which right you are exercising or protecting and why the record is required for that right, and provide proof of identity. The prescribed request fee (currently R140 for requesters other than personal requesters) is payable before processing; access and reproduction fees may apply as prescribed. Requests are answered within 30 days as required by PAIA, extendable once by up to 30 days where permitted. If your request is refused, reasons will be provided, and you may complain to the Information Regulator or apply to court.
6. Processing of personal information (POPIA summary)
Purpose of processing: responding to enquiries, providing quotes and previews, delivering and maintaining websites and systems, invoicing, and legal compliance. Categories of data subjects: prospective and current clients, website visitors, and clients' customers (where Webology acts as operator). Categories of information: names, contact details, business information, booking details, and billing information. Recipients: no third parties except service providers necessary for delivery (hosting, email) and where required by law. Cross-border transfers: data may be stored with cloud providers with servers outside South Africa, subject to adequate protection. Security measures: encrypted connections, access control, backups, and limited access as described in our Privacy Policy.
